By accessing our website (www.blockheaps.com), registering an account, or purchasing any interactive game-related content or virtual in-game items (collectively referred to as “Digital Content”), you agree to be bound by these Terms of Service.

1. Nature of Services & Delivery Mechanics

Blockheaps provides digital, interactive game-related content and virtual in-game items exclusively intended for entertainment use within the designated Blockheaps game environment.

  • Digital Supply Only: All content and items available through the website are supplied strictly in electronic/digital form. No physical products, goods, or tangible items will be shipped or supplied under any circumstances.
  • Instant Delivery & Completion: Digital Content becomes available and is permanently tied to the customer’s account immediately following the successful authorization and completion of the relevant credit card or payment transaction. The transaction is deemed fully executed and delivered at the exact moment of payment processing.

2. Purchase Basis & Single Transactions

  • One-Time Payments: All transactions processed through Blockheaps are strictly non-recurring, individual, one-time payments for the specific Digital Content selected at the absolute time of purchase.
  • No Subscriptions: Unless explicitly and prominently stated otherwise at the exact point of sale, no purchase shall establish a recurring billing agreement, subscription model, or any continuing payment obligation.

3. Strict No-Refund Policy & Waiver of Withdrawal Rights

Due to the digital and instantaneous nature of the fulfillment process, all transactions are final, non-refundable, and non-exchangeable.

  • EEA, UK & Statutory Rights Waiver: For customers located in the European Economic Area (EEA), the United Kingdom, or other jurisdictions where statutory withdrawal or cooling-off rights apply under applicable local law:
  • By completing a purchase and requesting immediate access to the purchased Digital Content, you provide your express prior consent and request for the immediate commencement of delivery.
  • You explicitly acknowledge and agree that once the delivery of digital content has commenced, you entirely waive and forfeit any statutory fourteen (14) day withdrawal, cancellation, or cooling-off rights otherwise applicable to distance contracts.
  • For the purposes of this provision, commencement of delivery includes, without limitation: access being granted to the purchased content, activation of content, account crediting, download availability, or any other form of electronic/digital fulfillment relating to the purchased content.

4. Proprietary Rights & Limited Use License (Intellectual Property Protection)

  • No Transfer of Ownership: The purchase of Digital Content does not transfer ownership, title, or any intellectual property rights of any virtual item, game element, character, source code, or media asset to the user.
  • Limited License: Any purchase grants the customer a highly limited, personal, non-exclusive, non-transferable, non-sublicensable, and fully revocable license to use the purchased content solely within the intended, authorized Blockheaps environment.
  • Unauthorized Activities: All rights, titles, and interests in and to Blockheaps remain exclusively vested in SPACE ROCK GAMES LIMITED. You are strictly prohibited from copying, modifying, extracting, redistributing, creating derivative works of, or exploiting any content for commercial purposes. Unauthorized use will result in immediate suspension or permanent termination of access.

5. Absolute Prohibition of Real-Money Trading (RMT) & Anti-Money Laundering

  • No Monetary Value: You explicitly acknowledge that game-related content and virtual items hold no real-world monetary value and cannot be redeemed, sold, or converted into real fiat currency, physical goods, or any other tangible assets.
  • Prohibition of External Trade: The sale, barter, gift, or transfer of Blockheaps accounts, user balances, or digital items outside of the official in-game interface is strictly prohibited. Any attempt to trade assets on third-party marketplaces or via unauthorized secondary markets will result in the immediate forfeiture of the assets and permanent account closure without a refund.

6. Anti-Fraud & Chargeback Prevention

  • Dispute Consequences: Initiating a fraudulent or bad-faith payment dispute or chargeback via your credit card issuer or bank (including through payment gateways like Stripe) constitutes a material breach of this contract.
  • Account Action: We reserve the absolute right to permanently terminate any user account associated with a disputed transaction.
  • Remedies: The Company reserves the right to report fraudulent chargebacks to payment processors, risk mitigation systems, and relevant credit reporting bureaus, and to pursue legal means to recover dispute fees and original balances.

7. Minimum Age Requirement

  • Age Limit: Blockheaps is strictly intended and designed only for persons aged eighteen (18) years or older.
  • Capacity and Liability: By utilizing this website or completing any purchase, you represent and warrant that you meet this age requirement and possess full legal capacity. If a minor uses a parent or guardian’s payment instrument without authorization, the registered cardholder/guardian shall assume full financial liability, and no refunds will be granted by the Company.

8. Privacy & Data Handling

Blockheaps processes necessary operational and customer data required for account administration, security verification, fraud prevention, and transaction processing. All data handling is conducted in compliance with relevant privacy obligations, including the New Zealand Privacy Act 2020 and, where applicable, the General Data Protection Regulation (GDPR) for European residents.
